Welcome to caibotlist.com (the "Service"), operated by CAIBotList ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website located at https://caibotlist.com (the "Website") and the chatbot search engine services provided thereon.

1. Description of Service

The Service provides a search engine designed to help users discover and find information about third-party chatbots ("Chatbots"). We index publicly available information about Chatbots and provide links to their respective platforms or websites. The Service is provided for informational purposes only.

2. Acceptance of Terms & Eligibility

  • Acceptance: By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms.
  • Eligibility:

    You must be at least 16 years old to use the general features of the Service. By using the Service, you represent and warrant that you meet this age requirement.

    Certain Chatbots or content accessible through the Service may be designated as intended for mature audiences (e.g., "NSFW" - Not Suitable For Work). You must be at least 18 years old to access or interact with any such designated Chatbots or content. By accessing such content, you represent and warrant that you are 18 years of age or older. We do not actively screen all third-party content for its nature, and you access all content, including potentially NSFW content, at your own risk and are responsible for complying with age restrictions.

    You must also have the legal capacity to enter into this agreement in your jurisdiction.

3. Acceptable Use Policy

You agree not to use the Service for any purpose that is unlawful or prohibited by these Terms, or any other purpose not reasonably intended by us. Specifically, you agree not to:

  • Use the Service in any way that violates any applicable local, national, or international law or regulation.
  • Scrape, data mine, reverse engineer, or collect information about the Service or its users in an automated manner without our express prior written consent.
  • Interfere with or disrupt the integrity or performance of the Service or the data contained therein.

  • Transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
  • Use the Service to find or promote Chatbots involved in illegal, harmful, hateful, or discriminatory activities.

4. Intellectual Property Rights

  • Our IP: The Service and its original content (excluding Third-Party Content as defined below), features, and functionality are and will remain the exclusive property of CAIBotList and its licensors. This includes, but is not limited to, our name, logo, website design, text, graphics, software, databases, and underlying code. These Terms do not grant you any right, title, or interest in the Service or Our IP, except for the limited right to access and use the Service as permitted by these Terms.
  • Third-Party IP: All names, logos, product and service names, designs, and slogans of third-party Chatbots or their platforms displayed through the Service ("Third-Party Content") are the trademarks and property of their respective owners. We do not claim any ownership over Third-Party Content. Your use of the Service does not grant you any license or right to use any Third-Party Content.

5. Third-Party Chatbots and Links

The Service provides search results and links to third-party Chatbots, websites, and resources that are not owned or controlled by us.

  • No Endorsement: We do not endorse, sponsor, recommend, or verify any Chatbots found through the Service. The inclusion of a Chatbot in our search results does not imply approval or endorsement.
  • No Responsibility: You acknowledge and agree that we are not responsible or liable for:
    • The availability, accuracy, content, functionality, legality, or safety of any third-party Chatbots or websites.
    • Any interaction, communication, or transaction you may have with any third-party Chatbot or its providers.
    • Any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such Chatbot, content, goods, or services available on or through any such third-party platforms.
  • Your Risk: You access and interact with third-party Chatbots entirely at your own risk. We strongly advise you to review the terms of service and privacy policies of any third-party Chatbot or website you visit or interact with.

6. Disclaimers of Warranties

THE SERVICE, INCLUDING ALL CONTENT AND SEARCH RESULTS, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • THE SERVICE WILL MEET YOUR REQUIREMENTS.
  • THE SEARCH RESULTS WILL BE ACCURATE, COMPLETE, RELIABLE, OR UP-TO-DATE.
  • THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
  • ANY ERRORS IN THE SERVICE WILL BE CORRECTED.
  • THE CHATBOTS FOUND THROUGH THE SERVICE ARE SAFE, FUNCTIONAL, OR FIT FOR ANY PURPOSE.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CAIBotList, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH:

  • YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE SERVICE;
  • THE CONTENT OR ACCURACY OF SEARCH RESULTS PROVIDED BY THE SERVICE;
  • YOUR INTERACTIONS OR TRANSACTIONS WITH ANY THIRD-PARTY CHATBOTS FOUND THROUGH THE SERVICE;
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

AS THE SERVICE IS PROVIDED FREE OF CHARGE, OUR LIABILITY FOR ANY DIRECT DAMAGES ARISING FROM YOUR USE OF THE SERVICE SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. THESE LIMITATIONS AND EXCLUSIONS APPLY REGARDLESS OF THE CAUSE OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE.

NOTHING IN THESE TERMS SHALL LIMIT OR EXCLUDE OUR LIABILITY FOR: (A) DEATH OR PERSONAL INJURY RESULTING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY DUTCH LAW.

8. Indemnification

You agree to defend, indemnify, and hold harmless CAIBotList, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your interactions with any third-party Chatbots found via the Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which can be found at https://caibotlist.com/privacy. By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

10. Modifications to the Service and Terms

  • Service Changes: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.
  • Terms Changes: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect (e.g., via a notice on the Website). What constitutes a material change will be determined at our sole discretion. Any dispute arising from or relating to the subject matter of these Terms shall be finally settled by the competent courts of Amsterdam, the Netherlands.

13. Miscellaneous

  • Entire Agreement: These Terms (together with the Privacy Policy) constitute the entire agreement between you and us regarding our Service and supersede and replace any prior agreements we might have between us regarding the Service.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
  • No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
  • Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
